On Oct 3, 2008, Greenville Attorney Suzanne Coe filed a lawsuit to stop the city of Myrtle Beach from enforcing three ordinances that target motorcycle rallies. The lawsuit focuses on the three ordinances that took effect immediately after the city passed them:
1. The amendment to the city’s noise ordinance that details noise standards to which vehicles must adhere.
2. The ordinance that declares bike rallies and other unpermitted events to be nuisances
3. The ordinance that says the city can hold those who promote such events liable for any expenses the city incurs when the events impact the city.
Among other charges, the lawsuit alleges:
• The city is acting unconstitutionally by restricting advertisers’ free speech;
• The city is infringing on interstate commerce
• The city is infringing on the business owners’ livelihoods because they are known as biker destination.
The city has overstepped its bounds by criminalizing noise violations beyond state law.A third lawsuit was filed to stop the city of Myrtle Beach from enforcing recently passed ordinances to curb the motorcycle rallies.
On October 4th, a lawsuit on behalf of Highlander Marketing Inc., Festival Promotions LLC and Myrtle Beach Harley-Davidson was filed against the city.
